One MKV H264 AC3 Audio/Video Sync Issue

I have 1 MKV file that is H264 AC3 that the audio and video are out of sync. I am using the tsmuxer as the primary encoding settings. If I select the memcoder version in the trancoding folder, then it plays fine. The video is Righteous Kill. I ripped it from the DVD and created the file using HandBreak. I used the same settings for other videos that I have created and those videos all play fine. I think that the first couple of seconds the video starts with no sound and that causes a problem with the tsmuxer, but I cannot be certain.

What can I provide to help with this?
